第1条（適用）
1. 本規約は、本サービスの利用条件及び本サービスの利用に関する山部直登（以下「サービス提供者」といいます。）と利用者との間の権利義務関係を定めることを目的とし、サービス提供者と利用者との間の本サービスの利用に関わる一切の関係に適用されます。本規約を契約内容として、利用者とサービス提供者の間で締結される本サービスの利用に係る契約を、以下「利用契約」といいます。
2. サービス提供者が(https://worldfishingmap.com/)において定める本サービスの仕様は、本規約の一部を構成するものとします。
3. 本規約の規定内容と、本規約外における本サービスの説明等（前項の本サービスの仕様を含みます。）の内容が異なる場合には、本規約の規定が優先して適用されるものとします。
第2条（定義）
1. 「本アプリ」：利用者が、本サービスを利用するためにダウンロードする必要のあるサービス提供者が提供するスマートフォン向けアプリケーション
2. 「利用登録」：本サービスを利用するために本サービス上で登録を受けること
3. 「登録希望者」：本サービスの利用を希望する者
4. 「ログイン情報」：Google認証又はApple ID認証を用いて本サービスにログインする際に必要なメールアドレス及びパスワード等の情報
5. 「水域」：海、川及び湖などの水面上又は水面から１００メートル以内の区域
6. 「水域判定機能」：釣果投稿について、当該釣果の位置情報を参照し、当該釣果が水域内で発生したものかを判定する機能
7. 「Tier」：サービス提供者が独自の基準により定める利用者のランク
8. 「釣果投稿」：利用者が、本サービス上に投稿する、自らの釣行の結果に関する情報
9. 「ダイレクトメッセージ」：利用者同士が、他の利用者から閲覧されない状態でメッセージをやり取りする機能
10. 「ミュート」：他の特定の利用者からのいいね、コメント又はダイレクトメッセージを受け取ったことに関する通知が自らの本アプリ上でなされないようにする機能
11. 「ブロック」：他の特定の利用者との間で、相互に、釣果投稿、コメント、ダイレクトメッセージ、ランキング及びプロフィールを表示しない機能
12. 「出撃スコア」：利用者の過去の釣果に関する情報と、風、波、海面水温、気圧の変化及び河川流量を考慮して、サービス提供者が独自に算定した釣果に対する期待度を示した数値
13. 「天候情報」：天気、降水確率及び降水量等の天候に関する情報
14. 「潮汐情報」：干潮時刻及び満潮時刻並びに潮位の変化等の潮汐や海面水位に関する情報
15. 「海況情報」：海上の風、波、海面水温、及び気圧並びに河川流量に関する情報
16. 「海洋情報」：海上保安庁が提供する情報を基に作成される、航路標識、底質及び等深線に関する情報
17. 「魚種情報」：AIシステムを用いて、釣果投稿に添付された写真に映った魚を分析した結果として得られる情報
18. 「魚類情報」：サービス提供者があらかじめ図鑑の形式で登録した魚類に関する情報
19. 「Fish Token」：サービス提供者が、独自の基準に従い、利用者に付与する数値
20. 「Angler's Point」：サービス提供者が、独自の基準に従い、利用者を評価した結果を表す数値
21. 「SMS2段階認証」：利用者が、電話番号をGoogleに提供し、Googleが当該電話番号にショートメッセージを送信することにより、2段階の本人確認を行うこと
22. 「お友達紹介」：利用者が、サービス提供者に対して、第三者を登録希望者として紹介すること
23. 「釣果情報」：釣果投稿に含まれる、釣った魚の魚種並びに釣った場所、時刻及び気象条件等の釣果に付随する情報
24. 「有料プラン」：利用契約を締結した利用者が、本サービスのうち、７条２項が定める「投稿の閲覧機能」及び７条４項が定める「情報の閲覧機能」について、通常よりも精度の高い仕様で利用することができるプラン（プレミアムプラン及びより精度が高いプロプランを含みます）
25. 「有料プラン登録」：サービス提供者が、サービス提供者が別途定める方法で有料プランの利用を申請した利用者に対し、有料プランの利用を認めること
第3条（登録）
1. 登録希望者は、利用登録を行うには、本アプリ上に表示されるGoogle又はAppleの認証画面に、ログイン情報を入力し、サービス提供者に対して、利用登録を希望する旨の申請を行う必要があります。
2. 利用登録の申請が行われた場合、Google又はAppleは、登録希望者が入力したログイン情報に基づき、登録希望者のログイン認証の可否を判断し、サービス提供者に判断の結果を通知します。
3. サービス提供者は、Google又はAppleからログインを認証した旨の通知を受け取った場合であって、利用登録申請に対し、利用登録を承諾するときには、当該登録希望者に対し、利用登録を認める旨の通知を送信します。
4. サービス提供者が前項の通知を発した時点で、サービス提供者と当該登録希望者の間に、本サービス利用契約が成立し、当該登録希望者の利用登録は完了します。
第4条（登録拒絶事由）
サービス提供者は、登録希望者が次の各号のいずれかに該当する場合には、本サービスの利用登録を拒否することができるものとします。
(1) 登録希望者が過去に本規約に違反したことその他の事由により、サービス提供者運営のサービスにおける利用停止、強制解約その他の処分を受けたことがある場合
(2) 本サービスを利用するためにサービス提供者に提供した情報の全部又は一部につき虚偽の記載、誤記、記載漏れ等があった場合
(3) 登録希望者が未成年者、成年被後見人、被保佐人又は被補助人の場合において、親権者、成年後見人、保佐人又は補助人の同意等が得られていない場合
(4) 本規約に違反するおそれがある場合
(5) 登録希望者が第２３条（反社会的勢力の排除）第１項各号に違反し又は過去に違反していた場合
(6) 前各号のほか、サービス提供者が利用登録を認めることが不適当であると判断した場合
第5条（登録事項の変更・通知）
1. 利用者は、登録した連絡先その他の登録事項に変更があった場合、サービス提供者が別途定める方法により、サービス提供者に対して変更内容を速やかに通知しなければなりません。
2. サービス提供者は、利用者が前項の通知を怠ったことによって当該利用者が損害を被った場合でも、サービス提供者に故意又は過失が認められない限り、当該損害について一切の責任を負いません。
第6条（ログイン情報の管理）
1. 利用者は、登録に用いたGoogleアカウント又はApple IDのログイン情報の利用及び管理について、一切の責任を負うものとします。
2. 利用者は、前項のログイン情報を第三者に譲渡、承継、貸与、開示又は漏洩してはならず、いかなる場合でもログイン情報を第三者に利用させてはならないものとします。
3. ログイン情報を用いてなされた本サービスの利用は、当該ログイン情報を管理すべき利用者による行為とみなします。また、これにより生じる責任はすべて利用者が負うものとします。ただし、サービス提供者の故意又は過失による場合、又はサービス提供者からメールアドレスが漏洩し、これにより第三者がログイン情報を利用した場合はこの限りではありません。
第7条（本サービスの内容）
1. 記録機能及び投稿機能
利用者が、釣果の写真及び位置情報をサービス提供者に提供し、これらを他の利用者に公開することに同意した場合であって、利用者の提供した位置情報が、サービス提供者の水域判定機能により水域であると判断されたときには、利用者は、記録機能及び投稿機能を利用することができます。
2. 投稿の閲覧機能
利用者は、本アプリ上で、当該利用者のTierに応じた仕様で、他の利用者の投稿を閲覧する機能を利用することができます。
3. コミュニケーション機能
(1) 利用者は、本アプリ上で、以下に掲げる方法で、他の利用者とやり取りを行うことができます。ただし、ウの方法については、TierがSilver以上の利用者に限って利用することができます。
ア 他の利用者の投稿にいいねを押す方法
イ 他の利用者の投稿にコメントを投稿する方法
ウ ダイレクトメッセージを利用する方法
(2) 前号にかかわらず、利用者は、他の特定の利用者を、ミュート又はブロックすることができます。利用者が、他の利用者からブロックされている場合には、当該他の利用者には、ダイレクトメッセージを送ることはできません。なお、送信されたダイレクトメッセージは、送信後、サービス提供者所定の期間が経過した後は、利用者の本アプリ上には表示されません。
4. 情報の閲覧機能
利用者は、サービス提供者が本アプリ上に表示した、以下の情報を閲覧することができます。ただし、５号の情報については、TierがGold以上の利用者に限って利用することができます。
(1) 出撃スコア
(2) 天候情報
(3) 潮汐情報
(4) 海況情報
(5) 海洋情報
(6) 魚種情報
(7) 魚類情報
第8条（有料プラン）
1. 利用契約を締結した利用者は、本サービスを無料で利用することができます。ただし、利用者は、有料プラン登録を行った上で、サービス提供者が別途定めるプランの種類に応じた毎月の有料プランの対価を、サービス提供者が指定する支払方法で支払うことにより、有料プランを利用することができます。
2. 利用者は、初めて有料プラン登録を行った場合には、有料プラン登録を行った日から７日の間、有料プランを無料で利用することができます。
3. 利用者は、有料プラン登録の解約を希望する場合には、サービス提供者が別途定める方法で有料プラン登録の解約手続を行う必要があります。なお、更新日の到来より前に解約がなされた場合であっても、利用者は、更新日が到来する日まで、有料プランを利用することができます。この場合、サービス提供者は、既に支払った有料プランの対価の返還は行いません。
第9条（ポイント制度）
1. サービス提供者は、サービス提供者所定の基準に従い、利用者に対して、以下のポイントを付与することができます。
(1) Fish Token
(2) Angler's Point
2. Angler's Pointは、サービス提供者が、利用者による本アプリの利用を通じた貢献という観点から利用者を評価した数値にすぎません。このため、利用者は、これにより直接的に何らかのサービスを受けること、金品との交換、金銭による購入又は他の利用者への譲渡はできません。
3. 利用者は、Fish Tokenを消費することで、以下の機能を利用することができます。なお、Fish Tokenは、サービス提供者が、利用者の釣果の信頼性及び客観的価値を評価して付与した数値にすぎず、金品との交換、金銭による購入又は他の利用者への譲渡はできません。
(1) 他の利用者の投稿について、正確な位置情報を閲覧する機能
(2) より高精度な魚種同定モデルを利用する機能
(3) Fish TokenをAngler's Pointに交換する機能
4. サービス提供者は、消費されたFish Tokenを返還しません。ただし、利用者がFish Tokenを適法に消費したにもかかわらず、サービス提供者の故意又は過失によって前項各号の機能を利用できなかった場合を除きます。
5. サービス提供者は、利用者が不正な手段を用いて第１項各号に掲げるポイントを取得した場合には、当該ポイントを抹消することができます。
第10条（お友達紹介制度）
利用者は、SMS２段階認証を行った場合に限り、お友達紹介を行うことができます。なお、サービス提供者は、お友達紹介を行った利用者に対して、次条で定めるTierの設定のほか、一切の対価を提供又は付与しません。
第11条（Tier制度）
1. サービス提供者は、以下の要素を考慮し、利用者にBronze/Silver/Gold/Platinumの４段階のTierを設定します。
(1) Angler's Point残高
(2) お友達紹介を行ったこと又はお友達紹介を受けた上で利用登録したこと
2. 第１項１号及び２号にかかわらず、サービス提供者がTierの価値の維持その他本サービスの運営に必要と考える事項を目的として、基準を変更することにより、Tierが変動することがあります。
3. 利用者は、自身のTierに応じた精度で、位置情報の表示機能及び分析機能を利用することができます。
第12条（本サービスの停止）
サービス提供者は、次の各号のいずれかに該当する場合、利用者に事前に通知することなく、本サービスの全部又は一部を停止することができるものとします。
(1) 本サービスに係るシステムの点検又は保守作業を定期的又は緊急に行う場合
(2) システムに負荷が集中した場合
(3) 不正アクセス、サイバー攻撃の発生等、利用者のセキュリティを確保する必要が生じた場合
(4) コンピュータ、通信回線等が事故その他の原因により停止した場合
(5) 火災、停電、天災地変又は重大な法令等の改廃等の不可抗力により本サービスの運営ができなくなった場合
(6) 本サービスと連携している、外部事業者が提供するサービス等に、トラブル、サービス提供の中断又は停止が生じた場合並びに本サービスとの連携の停止又は仕様変更等が生じた場合
(7) 前各号のほか、その他サービス提供者が本サービスの停止が必要であると合理的に判断した場合
第13条（本サービスの変更又は廃止）
1. サービス提供者は、サービス提供者が必要と判断する場合には、本サービスの一部又は全部を変更又は廃止することができるものとします。
2. 本サービスの一部又は全部を廃止する場合、サービス提供者は、廃止日の１ヵ月前までに利用者に通知するものとします。
3. 前項の規定にかかわらず、サービス提供者の予期しない事由又は火災、停電、天災地変若しくは重大な法令等の改廃等により、本サービスを廃止する場合において、前項による通知が困難な場合、サービス提供者は可能な限り速やかに利用者に対して通知を行うものとします。
第14条（禁止事項）
1. 利用者は、本サービスの利用に際し、自ら又は第三者をして、以下の各号のいずれかに該当する行為を行ってはならず、また、行わせてはなりません。
(1) 本サービスの運営、利用又は提供を妨げる行為
(2) サービス提供者が認める方法以外で本サービスを利用する行為
(3) サービス提供者に対し、虚偽の情報を申告等する行為
(4) 虚偽の釣果、撮影地点及び撮影日時をサービス提供者に提供する行為並びに同一の釣果について重複して投稿する行為その他の不正行為
(5) 漁業権の侵害、特定水産動植物の漁獲、その他漁業法をはじめとする水産業及び釣りに関する法令又は慣行に違反する行為
(6) 本サービスを利用して第三者に新たなサービスを提供等する行為
(7) アカウントを不正に利用し又は第三者に譲渡・貸与等する行為
(8) サービス提供者又は第三者の権利又は利益を侵害する行為
(9) サービス提供者又は利用者その他の第三者の名誉権、名誉感情、信用及びプライバシーを侵害する行為
(10) 異性との交際及びこれに類する目的をもって、本サービスを利用する行為
(11) コンピュータシステム又は通信回線等に悪影響を及ぼす行為
(12) 法令又は公序良俗に反する行為
(13) 前各号のほか、サービス提供者が不適切であると合理的に判断した行為
2. 利用者は、前項各号のいずれかに該当する行為がなされたことを知った場合、又は該当する行為がなされるおそれがあると判断した場合は、直ちにサービス提供者に通知するものとします。
第15条（利用停止・強制解約）
1. サービス提供者は、利用者が以下の各号のいずれかに該当する場合、当該利用者の承諾を得ることなく、本サービスの全部若しくは一部の利用を停止し、又は、本サービス利用契約を強制解約すること（以下総称して「利用停止等」といいます。）ができるものとします。
(1) 本規約に違反した場合
(2) 利用者が未成年者、成年被後見人、被保佐人又は被補助人のいずれかであるにもかかわらず、親権者、成年後見人、保佐人又は補助人の同意等を得ずに利用者となった場合
(3) 一定回数以上のパスワードの入力ミスがある等、アカウントのセキュリティを確保するために必要な場合
(4) 第２３条（反社会的勢力の排除）第１項各号に違反し又は過去に違反していた場合
(5) 前各号のほか、利用停止等の措置が必要であると合理的に認められる場合
2. 前項に基づく強制解約の場合、解約日は、サービス提供者が利用者を強制解約することを決定した日とします。
第16条（退会手続）
1. 利用者は、自ら本サービス利用契約を解約することを希望する場合には、サービス提供者が別途定める方法により、本サービス利用契約の解約手続を行うものとします。利用者の当該手続の完了をもって、本サービス利用契約は解約完了したものとし、解約完了利用者は本サービスの機能を利用することができなくなります。
2. 有料プラン登録をした利用者については、前項の解約完了をもって有料プラン登録も解約完了したものとみなします。
第17条（責任の制限）
利用者は、本サービスに起因又は関連して、サービス提供者の責めに帰すべき事由により損害を被った場合、サービス提供者に対して損害賠償を請求することができるものとします。ただし、サービス提供者に故意又は重過失がある場合を除き、サービス提供者が利用者に対して負担する損害賠償責任の範囲は、通常損害に限定されるものとし、サービス提供者は、逸失利益その他特別の事情によって発生した損害について、責任を負わないものとします。
第18条（利用者の責任・保証の否認）
1. 利用者は、本サービスを利用するにあたり、次の事項を遵守しなければなりません。
(1) あらかじめ本規約その他サービス提供者がウェブサイト上で提供する各種の説明及び注意事項等をよく読んで確認し、本サービスの内容及び仕組みを十分に理解した上で、自らの責任と判断において、本サービスを利用すること
(2) 本サービス又は本アプリに関連して他の利用者又は第三者との間において生じた取引、連絡、紛争等については、利用者が自己の責任によって解決すること
2. 利用者は、サービス提供者が次の事項について保証しないことをあらかじめ承諾することとします。
(1) 水域判定、天候情報、潮汐情報、海況情報、魚種情報等の本サービス上で表示される各情報が利用者の期待する機能又は商品的価値、正確性及び有用性を有すること
(2) 期待どおりの釣果が得られること、期待どおりに釣果投稿を行えること、釣果投稿の掲載が継続されること、その他の本サービスの内容及び結果が利用者の特定の目的に適合すること
(3) 本サービスを利用することが、利用者に適用のある法令又は業界団体の内部規則等に適合すること
(4) 本サービスを継続的に利用できること及び不具合が生じないこと
3. 利用者は、本規約に違反し、これによってサービス提供者が損害を被った場合、サービス提供者の請求に従って直ちに当該損害（合理的な範囲の弁護士費用を含みます。）を賠償するものとします。
第19条（知的財産権の帰属）
1. 本サービスに関する知的財産権(特許権、実用新案権、意匠権、著作権（著作権法第２７条及び第２８条の権利を含みます。）、商標権その他の知的財産に関して法令によって定められた権利（ノウハウ及び営業秘密を含みます。）はすべて、サービス提供者又はサービス提供者に許諾する第三者に帰属するものであり、利用者に対してこれらの権利を譲渡するものではなく、また、本規約に定める以上の許諾を行うものではありません。利用者は、サービス提供者又はサービス提供者に許諾する第三者の知的財産権を侵害しないものとします。
2. 前項にかかわらず、本サービスに関して、利用者が投稿した釣果投稿及びこれに含まれる写真並びにコメントの著作権（著作権法第２７条及び第２８条の権利を含みます。）は、投稿者である利用者に帰属します。
3. 利用者は、サービス提供者に対し、釣果投稿に含まれる写真及び釣果情報を、本アプリの運営に必要な範囲で、無償かつ地域を限定せずに、利用することを許諾しなければなりません。また、利用者は、サービス提供者が本サービスを提供することを目的として釣果投稿に含まれる写真及び釣果情報を利用することに対し、著作者人格権又は肖像権等の人格権を行使しないものとします。
第20条（秘密保持）
利用者は、書面、口頭その他方法又は媒体を問わず、サービス提供者のサービス及びサービス提供者との連絡内容のうちサービス提供者が秘密として取り扱うことを要請した情報について、本サービスの利用目的以外に使用し、又は第三者に提供、開示若しくは漏洩しないものとします。ただし、サービス提供者の事前の書面による承諾があった場合には、この限りではありません。
第21条（通信の秘密の取り扱い）
1. サービス提供者は、本サービスにおける利用者間のダイレクトメッセージその他の非公開の通信情報のうち、電気通信事業法４条が「通信の秘密」と定める情報（以下「秘密情報」といいます。）については、原則としてその内容を閲覧しないものとします。
2. 前項にかかわらず、利用者は、サービス提供者が、以下の利用目的のいずれかに基づいて、かつ以下の利用方法の範囲内で、サービス提供者が、当該秘密情報を知得、保存又は第三者への提供をすることをあらかじめ承諾するものとします。
(1) 利用目的
ア 利用者が本規約第１４条が定める禁止行為その他本規約に違反する行為を行い、又は行うおそれがあると合理的に疑われる場合で、当該禁止行為の有無を判断するために当該秘密情報が必要であるとき
イ サービス提供者が、当該秘密情報の送信者又は受信者である利用者に対して連絡をとるために、当該秘密情報が必要であると認められる場合
ウ 利用者並びにサービス提供者及びサービス提供者に所属する従業員（サービス提供者が雇用契約を締結する者のほか、業務委託契約を締結する個人も含みます。）の生命、身体又は財産を保護するために、当該秘密情報が必要であると認められる場合
エ その他、サービス提供者が本サービスを維持する上で、当該秘密情報が不可欠である場合
(2) 利用方法
ア サービス提供者が、本項に基づいて秘密情報を知得する場合、本項に基づいて秘密情報を直接的に知得する者は、サービス提供者に所属する従業員（雇用契約を締結する者のほか、業務委託契約を締結する個人も含みます。）に限られるものとします。
イ サービス提供者が、本項に基づいて秘密情報を保存又は複製する場合、前号の利用目的を達成したときは、速やかに当該秘密情報（複製したものも含みます。）を消去するものとします。
ウ サービス提供者が、本項に基づいて秘密情報を第三者に提供する場合、その提供先は以下に限られるものとし、かつ提供する秘密情報の範囲も前号の利用目的の達成に必要な範囲に限られるものとします。
(ア) 裁判所、官公庁、警察、弁護士会その他公的機関
(イ) 弁護士、公認会計士、税理士、コンサルタントその他の法律又は契約上の守秘義務を負う専門家
第22条（個人情報の取扱い）
サービス提供者は、本サービスの提供にあたり、個人情報の保護に関する法律（以下「個人情報保護法」といい、前条が定める「通信の秘密」に該当する情報は除きます。）及びサービス提供者の「プライバシーポリシー」(https://worldfishingmap.com/privacy)に従って、利用者がサービス提供者に提供し、又は本サービスを通じて提供した個人情報（個人情報保護法において定義される「個人情報」をいいます。）を適正に取り扱います。
第23条（反社会的勢力の排除）
1. 利用者は、サービス提供者に対し、以下の各号の事項について現在及び将来にわたって誓約します。
(1) 自らが反社会的勢力に該当しないこと
(2) 反社会的勢力との間で社会的に非難される関係性を有していないこと
(3) 暴力的・脅迫的な要求行為、業務妨害・信用毀損行為その他違法行為をしていないこと
(4) 反社会的勢力に自らの名義を貸していないこと
(5) 自ら又は第三者を利用して、本サービスの利用に関して次の行為をしないこと
ア サービス提供者又は第三者に対する脅迫的な言動又は暴力を用いる行為
イ 偽計又は威力を用いてサービス提供者の業務を妨害し、又は信用を毀損する行為
2. 利用者が前項に違反し、サービス提供者が第１５条（利用停止・強制解約）に基づく措置を講じたとしても、利用者は、当該措置により生じた一切の損害の賠償を請求することはできません。
第24条（権利義務の譲渡禁止）
1. 利用者は、利用契約上の地位又はこれに基づく権利若しくは義務を、第三者に対し、譲渡、移転、承継、担保設定その他の処分をしてはならないものとします。
2. サービス提供者は、本サービスに係る事業を第三者に譲渡し、又は承継する場合、サービス提供者と利用者との間の契約上の地位並びにこれに基づく権利及び義務、利用者の情報を当該第三者に譲渡又は承継できるものとし、利用者は、これにあらかじめ同意するものとします。
第25条（分離可能性）
本規約のいずれかの条項又はその一部が無効又は違法とされた場合であっても、本規約の残りの条項又はその一部は影響を受けず、有効に維持されるものとします。
第26条（言語）
本規約の正文は日本語版とし、他の言語への翻訳版との相違や矛盾が生じた場合日本語版が優先して適用されるものとします。
第27条（準拠法）
本規約は、日本法を準拠法とします。
第28条（管轄裁判所）
本規約に起因又は関連して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
第29条（規約の変更）
1. 本規約の内容は、必要に応じ、利用者の一般の利益に適合する範囲又は本規約の目的に反せず合理的な範囲で、変更されることがあります。
2. 前項に従い本規約を変更する場合、サービス提供者は、変更後の本規約の内容及びその効力発生時期を、本サービス上の適宜の場所への掲載その他適切な方法により周知するものとし、変更後の本規約は、当該効力発生時期が到来した時点で効力を生じるものとします。

Article 1 (Application)
1. These Terms set out the conditions for use of the Service and the rights and obligations between Naoto Yamabe (the "Service Provider") and users in connection with use of the Service, and apply to all relationships between the Service Provider and users relating to use of the Service. The contract for use of the Service concluded between a user and the Service Provider with these Terms as its content is hereinafter referred to as the "User Agreement."
2. The specifications of the Service set out by the Service Provider at (https://worldfishingmap.com/) form part of these Terms.
3. If the provisions of these Terms differ from descriptions of the Service outside these Terms (including the specifications referred to in the preceding paragraph), the provisions of these Terms prevail.
Article 2 (Definitions)
1. "App": the smartphone application provided by the Service Provider that users must download in order to use the Service
2. "Registration": being registered on the Service in order to use the Service
3. "Applicant": a person who wishes to use the Service
4. "Login Credentials": the email address, password, and other information required to log in to the Service using Google or Apple ID authentication
5. "Water Area": an area on, or within 100 meters of, the surface of water such as seas, rivers, and lakes
6. "Water Area Determination Function": a function that refers to the location information of a catch post and determines whether the catch occurred within a Water Area
7. "Tier": a rank of users determined by the Service Provider based on its own criteria
8. "Catch Post": information about the results of a user's own fishing trip that the user posts on the Service
9. "Direct Message": a function that allows users to exchange messages with each other in a state that cannot be viewed by other users
10. "Mute": a function that stops notifications on the user's own App about likes, comments, or Direct Messages received from a specific other user
11. "Block": a function under which catch posts, comments, Direct Messages, rankings, and profiles are mutually hidden between the user and a specific other user
12. "Bite Score": a numerical value, calculated independently by the Service Provider, indicating the level of expectation for fishing results, taking into account information about the user's past catches together with wind, waves, sea surface temperature, changes in atmospheric pressure, and river discharge
13. "Weather Information": information about the weather, such as conditions, probability of precipitation, and amount of precipitation
14. "Tide Information": information about tides and sea levels, such as low and high tide times and changes in tide level
15. "Marine Conditions Information": information about wind, waves, sea surface temperature, and atmospheric pressure at sea, and river discharge
16. "Ocean Information": information on aids to navigation, seabed sediment, and depth contours, created based on information provided by the Japan Coast Guard
17. "Species Information": information obtained as a result of analyzing, using an AI system, the fish shown in a photo attached to a catch post
18. "Fish Encyclopedia Information": information about fish registered in advance by the Service Provider in the form of an encyclopedia
19. "Fish Token": a numerical value granted by the Service Provider to users in accordance with its own criteria
20. "Angler's Point": a numerical value representing the result of the Service Provider's evaluation of a user in accordance with its own criteria
21. "SMS Two-Step Verification": two-step identity verification performed by the user providing a phone number to Google and Google sending a short message to that phone number
22. "Friend Referral": a user introducing a third party to the Service Provider as an Applicant
23. "Catch Information": information included in a catch post that accompanies the catch, such as the species of the fish caught and the place, time, and weather conditions of the catch
24. "Paid Plan": a plan under which a user who has concluded the User Agreement can use the "post viewing function" set out in Article 7, Paragraph 2 and the "information viewing function" set out in Article 7, Paragraph 4 with higher precision than usual (including the Premium Plan and the higher-precision Pro Plan)
25. "Paid Plan Registration": the Service Provider permitting use of a Paid Plan to a user who has applied for use of a Paid Plan by the method separately specified by the Service Provider
Article 3 (Registration)
1. To complete Registration, an Applicant must enter their Login Credentials on the Google or Apple authentication screen displayed in the App and submit an application to the Service Provider indicating that they wish to register.
2. When an application for Registration is made, Google or Apple determines whether the Applicant's login can be authenticated based on the Login Credentials entered, and notifies the Service Provider of the result.
3. When the Service Provider receives notice from Google or Apple that the login has been authenticated, and accepts the application for Registration, it sends the Applicant a notice approving the Registration.
4. The User Agreement between the Service Provider and the Applicant is formed, and the Applicant's Registration is completed, at the time the Service Provider issues the notice under the preceding paragraph.
Article 4 (Grounds for Refusal of Registration)
The Service Provider may refuse Registration if an Applicant falls under any of the following items:
(1) the Applicant has in the past been subject to suspension of use, forced termination, or other measures in a service operated by the Service Provider due to violation of these Terms or for other reasons;
(2) all or part of the information provided to the Service Provider in order to use the Service contains false statements, errors, or omissions;
(3) the Applicant is a minor, an adult ward, a person under curatorship, or a person under assistance, and the consent or the like of a person with parental authority, an adult guardian, a curator, or an assistant has not been obtained;
(4) there is a risk of violation of these Terms;
(5) the Applicant violates, or has in the past violated, any item of Article 23 (Exclusion of Anti-Social Forces), Paragraph 1; or
(6) in addition to the preceding items, the Service Provider determines that approving the Registration is inappropriate.
Article 5 (Changes to Registered Information; Notice)
1. If there is any change to a registered contact or other registered information, the user must promptly notify the Service Provider of the details of the change by the method separately specified by the Service Provider.
2. Even if a user suffers damage as a result of failing to give the notice under the preceding paragraph, the Service Provider bears no responsibility whatsoever for such damage unless intent or negligence is found on the part of the Service Provider.
Article 6 (Management of Login Credentials)
1. Users bear full responsibility for the use and management of the Login Credentials of the Google account or Apple ID used for Registration.
2. Users must not assign, transfer by succession, lend, disclose, or leak the Login Credentials referred to in the preceding paragraph to any third party, and must not allow any third party to use the Login Credentials under any circumstances.
3. Any use of the Service made using Login Credentials is deemed to be an act of the user who is responsible for managing those Login Credentials, and the user bears all responsibility arising from such use; provided, however, that this does not apply where the use results from the Service Provider's intent or negligence, or where the email address is leaked from the Service Provider and a third party uses the Login Credentials as a result.
Article 7 (Contents of the Service)
1. Recording function and posting function
Where a user provides photos and location information of a catch to the Service Provider and consents to making them public to other users, and the location information provided by the user is determined to be a Water Area by the Service Provider's Water Area Determination Function, the user may use the recording function and the posting function.
2. Post viewing function
Users may use the function of viewing other users' posts in the App, with specifications according to the user's Tier.
3. Communication functions
(1) Users may interact with other users in the App by the following methods; provided, however, that method (c) may be used only by users whose Tier is Silver or higher:
(a) liking another user's post;
(b) posting a comment on another user's post;
(c) using Direct Messages.
(2) Notwithstanding the preceding item, a user may Mute or Block a specific other user. Where a user has been Blocked by another user, that other user cannot be sent Direct Messages by the Blocked user. A sent Direct Message will no longer be displayed on the user's App after a period specified by the Service Provider has elapsed following transmission.
4. Information viewing function
Users may view the following information displayed in the App by the Service Provider; provided, however, that the information in item (5) may be used only by users whose Tier is Gold or higher:
(1) Bite Score
(2) Weather Information
(3) Tide Information
(4) Marine Conditions Information
(5) Ocean Information
(6) Species Information
(7) Fish Encyclopedia Information
Article 8 (Paid Plans)
1. Users who have concluded the User Agreement may use the Service free of charge; provided, however, that a user may use a Paid Plan by completing Paid Plan Registration and paying the monthly Paid Plan fee corresponding to the type of plan separately specified by the Service Provider, by the payment method designated by the Service Provider.
2. A user who completes Paid Plan Registration for the first time may use the Paid Plan free of charge for a period of seven days from the date of Paid Plan Registration.
3. A user who wishes to cancel Paid Plan Registration must carry out the cancellation procedure by the method separately specified by the Service Provider. Even where cancellation is made before a renewal date arrives, the user may use the Paid Plan until the renewal date arrives; in this case, the Service Provider will not refund any Paid Plan fees already paid.
Article 9 (Point System)
1. The Service Provider may grant the following points to users in accordance with criteria specified by the Service Provider:
(1) Fish Token
(2) Angler's Point
2. Angler's Point is merely a numerical value by which the Service Provider evaluates a user from the perspective of contribution through use of the App. Accordingly, users cannot directly receive any service through it, exchange it for money or goods, purchase it with money, or transfer it to other users.
3. Users may use the following functions by consuming Fish Tokens. Fish Token is merely a numerical value granted by the Service Provider based on its evaluation of the reliability and objective value of the user's catches, and cannot be exchanged for money or goods, purchased with money, or transferred to other users:
(1) a function for viewing the precise location information of another user's post;
(2) a function for using a higher-precision species identification model;
(3) a function for exchanging Fish Tokens for Angler's Points.
4. The Service Provider will not return consumed Fish Tokens; provided, however, that this does not apply where the user lawfully consumed Fish Tokens but was unable to use the functions listed in the preceding paragraph due to the Service Provider's intent or negligence.
5. The Service Provider may cancel points listed in Paragraph 1 where a user has acquired them by wrongful means.
Article 10 (Friend Referral Program)
Users may make Friend Referrals only where they have completed SMS Two-Step Verification. The Service Provider will not provide or grant any consideration whatsoever to a user who makes a Friend Referral, other than the Tier setting provided for in the following article.
Article 11 (Tier System)
1. The Service Provider sets one of four Tiers — Bronze, Silver, Gold, or Platinum — for each user, taking the following factors into account:
(1) the user's Angler's Point balance;
(2) having made a Friend Referral, or having completed Registration after receiving a Friend Referral.
2. Notwithstanding items (1) and (2) of Paragraph 1, Tiers may change as a result of the Service Provider changing the criteria for purposes that the Service Provider considers necessary for maintaining the value of Tiers or otherwise for the operation of the Service.
3. Users may use the location information display function and analysis functions at a precision corresponding to their own Tier.
Article 12 (Suspension of the Service)
The Service Provider may suspend all or part of the Service without prior notice to users in any of the following cases:
(1) where inspection or maintenance work on systems related to the Service is carried out periodically or urgently;
(2) where load is concentrated on the system;
(3) where it becomes necessary to ensure the security of users due to unauthorized access, cyber-attacks, or the like;
(4) where computers, communication lines, or the like stop due to accident or other causes;
(5) where operation of the Service becomes impossible due to force majeure such as fire, power outage, natural disaster, or major enactment or repeal of laws and regulations;
(6) where trouble, interruption, or suspension of provision occurs in services provided by external providers with which the Service is linked, or where linkage with the Service is suspended or specifications are changed; or
(7) in addition to the preceding items, where the Service Provider reasonably determines that suspension of the Service is necessary.
Article 13 (Modification or Discontinuation of the Service)
1. The Service Provider may modify or discontinue part or all of the Service where the Service Provider determines it necessary.
2. Where part or all of the Service is to be discontinued, the Service Provider will notify users no later than one month before the date of discontinuation.
3. Notwithstanding the preceding paragraph, where the Service is discontinued due to circumstances unforeseen by the Service Provider or due to fire, power outage, natural disaster, major enactment or repeal of laws and regulations, or the like, and notice under the preceding paragraph is difficult, the Service Provider will notify users as promptly as possible.
Article 14 (Prohibited Acts)
1. In using the Service, users must not engage in, or cause a third party to engage in, any act falling under any of the following items:
(1) acts that obstruct the operation, use, or provision of the Service;
(2) using the Service by methods other than those approved by the Service Provider;
(3) declaring or reporting false information to the Service Provider;
(4) providing false catches, capture locations, or capture dates/times to the Service Provider, posting the same catch more than once, or other wrongful acts;
(5) infringement of fishery rights, harvesting of specified aquatic animals and plants, or other acts violating the Fishery Act or other laws, regulations, or customs concerning the fishing industry and fishing;
(6) using the Service to provide new services or the like to third parties;
(7) wrongfully using an account, or assigning, lending, or otherwise transferring it to a third party;
(8) acts that infringe the rights or interests of the Service Provider or third parties;
(9) acts that infringe the honor, feelings of honor, credit, or privacy of the Service Provider, users, or other third parties;
(10) using the Service for the purpose of romantic association or similar purposes;
(11) acts that adversely affect computer systems, communication lines, or the like;
(12) acts contrary to laws and regulations or public order and morals;
(13) in addition to the preceding items, acts that the Service Provider reasonably determines to be inappropriate.
2. Where a user learns that an act falling under any item of the preceding paragraph has been committed, or determines that there is a risk that such an act will be committed, the user shall immediately notify the Service Provider.
Article 15 (Suspension of Use; Forced Termination)
1. Where a user falls under any of the following items, the Service Provider may, without obtaining the user's consent, suspend the user's use of all or part of the Service, or forcibly terminate the User Agreement (hereinafter collectively referred to as "Suspension Measures"):
(1) where the user has violated these Terms;
(2) where the user is a minor, an adult ward, a person under curatorship, or a person under assistance and became a user without obtaining the consent or the like of a person with parental authority, an adult guardian, a curator, or an assistant;
(3) where necessary to ensure the security of the account, such as where the password has been entered incorrectly a certain number of times or more;
(4) where the user violates, or has in the past violated, any item of Article 23 (Exclusion of Anti-Social Forces), Paragraph 1; or
(5) in addition to the preceding items, where Suspension Measures are reasonably found to be necessary.
2. In the case of forced termination under the preceding paragraph, the termination date is the date on which the Service Provider decides to forcibly terminate the user.
Article 16 (Withdrawal Procedure)
1. A user who wishes to terminate the User Agreement on their own initiative shall carry out the termination procedure for the User Agreement by the method separately specified by the Service Provider. The User Agreement is terminated upon the user's completion of that procedure, and a user who has completed termination can no longer use the functions of the Service.
2. For a user who has completed Paid Plan Registration, the Paid Plan Registration is also deemed terminated upon completion of the termination under the preceding paragraph.
Article 17 (Limitation of Liability)
Where a user suffers damage due to causes attributable to the Service Provider arising out of or in connection with the Service, the user may claim compensation for damage from the Service Provider; provided, however, that, except where there is intent or gross negligence on the part of the Service Provider, the scope of the Service Provider's liability for damage to the user is limited to ordinary damage, and the Service Provider is not liable for lost profits or other damage arising from special circumstances.
Article 18 (User Responsibility; Disclaimer of Warranties)
1. In using the Service, users must comply with the following:
(1) to read and confirm in advance these Terms and the various explanations and cautions provided by the Service Provider on its website, to fully understand the contents and mechanics of the Service, and to use the Service at their own responsibility and judgment;
(2) to resolve, at their own responsibility, any transactions, communications, disputes, or the like arising with other users or third parties in connection with the Service or the App.
2. Users acknowledge in advance that the Service Provider does not warrant the following matters:
(1) that the Water Area determination, Weather Information, Tide Information, Marine Conditions Information, Species Information, and other information displayed on the Service have the functionality or commercial value, accuracy, and usefulness that the user expects;
(2) that the expected fishing results will be obtained, that catch posts can be made as expected, that publication of catch posts will continue, or that the contents and results of the Service otherwise suit the user's particular purposes;
(3) that use of the Service complies with laws and regulations applicable to the user or internal rules of industry organizations and the like;
(4) that the Service can be used continuously and that no defects will occur.
3. Where a user violates these Terms and the Service Provider suffers damage as a result, the user shall immediately compensate for such damage (including attorneys' fees within a reasonable scope) in accordance with the Service Provider's demand.
Article 19 (Attribution of Intellectual Property Rights)
1. All intellectual property rights concerning the Service (patent rights, utility model rights, design rights, copyrights (including the rights under Articles 27 and 28 of the Copyright Act), trademark rights, and other rights established by laws and regulations concerning intellectual property (including know-how and trade secrets)) belong to the Service Provider or to third parties who grant licenses to the Service Provider; these rights are not assigned to users, and no license is granted beyond what is provided in these Terms. Users must not infringe the intellectual property rights of the Service Provider or of third parties who grant licenses to the Service Provider.
2. Notwithstanding the preceding paragraph, with respect to the Service, the copyright (including the rights under Articles 27 and 28 of the Copyright Act) in catch posts posted by a user, photos included in them, and comments belongs to the user who posted them.
3. Users shall grant the Service Provider a license to use the photos and Catch Information included in catch posts, free of charge and without geographic limitation, to the extent necessary for the operation of the App. Users shall not exercise moral rights of authors, portrait rights, or other personal rights against the Service Provider's use of the photos and Catch Information included in catch posts for the purpose of providing the Service.
Article 20 (Confidentiality)
Users shall not use, other than for the purpose of using the Service, or provide, disclose, or leak to third parties, any information — regardless of whether in writing, oral, or any other method or medium — concerning the Service Provider's services or the contents of communications with the Service Provider that the Service Provider has requested be treated as confidential; provided, however, that this does not apply where the Service Provider's prior written consent has been obtained.
Article 21 (Handling of the Secrecy of Communications)
1. The Service Provider will, in principle, not view the contents of information that Article 4 of the Telecommunications Business Act defines as the "secrecy of communications" (hereinafter "Confidential Information") among Direct Messages and other non-public communication information between users on the Service.
2. Notwithstanding the preceding paragraph, users consent in advance that the Service Provider may come to know, store, or provide to third parties such Confidential Information, based on any of the following purposes of use and within the scope of the following methods of use:
(1) Purposes of use
(a) where a user commits, or is reasonably suspected of committing or being likely to commit, a prohibited act under Article 14 of these Terms or another act violating these Terms, and the Confidential Information is necessary to determine whether the prohibited act has occurred;
(b) where the Confidential Information is found to be necessary for the Service Provider to contact the user who is the sender or recipient of the Confidential Information;
(c) where the Confidential Information is found to be necessary to protect the life, body, or property of users, of the Service Provider, or of personnel belonging to the Service Provider (including persons with whom the Service Provider concludes employment contracts as well as individuals with whom it concludes service (outsourcing) contracts);
(d) in other cases where the Confidential Information is indispensable for the Service Provider to maintain the Service.
(2) Methods of use
(a) where the Service Provider comes to know Confidential Information under this paragraph, the persons who directly come to know the Confidential Information under this paragraph are limited to personnel belonging to the Service Provider (including persons with employment contracts as well as individuals with service (outsourcing) contracts);
(b) where the Service Provider stores or copies Confidential Information under this paragraph, it will promptly delete the Confidential Information (including copies) once the purpose of use in the preceding item has been achieved;
(c) where the Service Provider provides Confidential Information to third parties under this paragraph, the recipients are limited to the following, and the scope of Confidential Information provided is limited to the scope necessary to achieve the purposes of use in item (1):
(i) courts, government agencies, police, bar associations, and other public authorities;
(ii) attorneys, certified public accountants, certified tax accountants, consultants, and other professionals who owe statutory or contractual confidentiality obligations.
Article 22 (Handling of Personal Information)
In providing the Service, the Service Provider will appropriately handle personal information ("personal information" as defined in the Act on the Protection of Personal Information) that users provide to the Service Provider or provide through the Service, in accordance with the Act on the Protection of Personal Information (hereinafter the "Personal Information Protection Act"; information falling under the "secrecy of communications" set out in the preceding article is excluded) and the Service Provider's Privacy Policy (https://worldfishingmap.com/privacy).
Article 23 (Exclusion of Anti-Social Forces)
1. Users covenant to the Service Provider, both at present and in the future, as to the following matters:
(1) that they do not fall under anti-social forces;
(2) that they have no socially condemnable relationship with anti-social forces;
(3) that they do not engage in violent or threatening demands, obstruction of business, damage to credit, or other illegal acts;
(4) that they do not lend their name to anti-social forces;
(5) that they will not, by themselves or through the use of third parties, engage in the following acts in connection with use of the Service:
(a) acts using threatening speech or behavior or violence against the Service Provider or third parties;
(b) acts obstructing the Service Provider's business or damaging its credit through the use of fraudulent means or force.
2. Even where a user violates the preceding paragraph and the Service Provider takes measures based on Article 15 (Suspension of Use; Forced Termination), the user may not claim compensation for any damage arising from such measures.
Article 24 (No Assignment of Rights and Obligations)
1. Users must not assign, transfer, cause to be succeeded, create security interests over, or otherwise dispose of their status under the User Agreement or their rights or obligations based on the User Agreement to third parties.
2. Where the Service Provider assigns to a third party, or causes a third party to succeed to, the business relating to the Service, the Service Provider may assign or cause to be succeeded to that third party its contractual status with users, the rights and obligations based on it, and user information, and users consent to this in advance.
Article 25 (Severability)
Even where any provision of these Terms or part thereof is held invalid or illegal, the remaining provisions of these Terms or the remaining parts thereof shall remain unaffected and continue in full force and effect.
Article 26 (Language)
The official text of these Terms is the Japanese version; in the event of any difference or conflict with a translation into another language, the Japanese version prevails.
Article 27 (Governing Law)
These Terms are governed by the laws of Japan.
Article 28 (Court of Jurisdiction)
Where a dispute arises out of or in connection with these Terms, the Tokyo District Court has exclusive jurisdiction as the court of first instance.
Article 29 (Amendment of these Terms)
1. The contents of these Terms may be amended as necessary, to the extent conforming to the general interest of users or to a reasonable extent not contrary to the purpose of these Terms.
2. When amending these Terms in accordance with the preceding paragraph, the Service Provider will announce the contents of the amended Terms and the time they take effect, by posting in an appropriate place on the Service or by other appropriate means, and the amended Terms take effect at the time the announced effective time arrives.
